A Manhattan Criminal Court found Nick Liu not guilty of molesting his roommate’s girlfriend after his defense that he was sleepwalking when the incident occurred.
The New York Post reported that Liu’s roommate, Shane Payne had flown his girlfriend up from Florida for a romantic weekend. After a few drinks, Payne and his friend returned to the shared apartment and enjoyed sex.
The unidentified woman testified that she fell asleep and awoke to find Liu kissing and molesting her.
Liu mounted the unusual defense that he was not responsible for his actions as he was sleepwalking at the time and unaware of what he was doing.
Liu’s mother testified that her son had suffered from a sleep disorder since childhood. Liu’s girlfriend also took the stand and said that several times a month Liu would grab her breasts and vagina several times a month while he was asleep.
A Manhattan jury agreed with Liu that he was not aware of what he was doing and found him not guilty.
